Changes to Highly Qualified Specialists Regulation in 2024

The Federal Law No. 316-FZ dated 10 July 2023 has brought significant amendments to the legislation governing the legal status of foreign nationals, including Highly Qualified Specialists (HQS), in the Russian Federation. These changes will come into effect starting from 2024. Here's what you need to know:

HQS Salary Increase in March 2024

The law now mandates an increase in the minimum salary threshold for HQS to 750,000 rubles payable quarterly from March 1, 2024. The provision concerning the salary of at least RUB 750,000 per quarter will apply to the 1st quarter 2024 in case the relevant HQS employment remains active as of March 1, 2024. In case the employment is terminated before March 1, 2024, this provision will not apply for such assignees.

Collection of Issued Work Permit within 30 days

According to the amendments coming into force from January 7, 2024, HQS will have a strict deadline of 30 calendar days from the Ministry of Internal Affairs' decision to issue or extend their work permit to collect it. If required, this period may be extended by a maximum of 30 calendar days, subject to valid reasons and employer approval.

Indefinite Residence Permit

Starting from 2024, HQS will have an opportunity to obtain an Indefinite Residence Permit (IRP) that is not linked to their HQS status. To be eligible for this, three conditions must be met:

  1. Have at least 2 years of work experience in the Russian Federation under HQS status.
  2. Before applying for a permanent residence permit, it is mandatory to have resided in Russia based on a residence permit linked to the validity of the HQS work permit. An HQS employee must be employed in Russia in this status for at least two years and also must reside in Russia for at least two years based on a HQS Permanent Residence Permit issued for the period of the work permit validity.
  3. Ensure proper payment of taxes during the specified two-year period of HQS work in Russia.

These changes are aimed at enhancing and streamlining the legal status of foreign nationals in Russia.
